1. About BANDGATE

BANDGATE ("we," "us," or "our") is an AI-powered IELTS examination preparation platform operated as a digital software-as-a-service (SaaS) product. BANDGATE provides tools including AI-generated mock tests, speaking practice with real-time feedback, writing evaluation, vocabulary training, and personalised study plans.

These Terms of Service ("Terms") govern your access to and use of BANDGATE's website, web application, and related services (collectively, the "Service").

2. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that:

• You are at least 13 years of age (or the age of digital consent in your jurisdiction)
• You have read, understood, and agree to be bound by these Terms
• You have the authority to enter into this agreement

If you do not agree to these Terms, you must not use the Service.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent.

4. Subscription Plans and Payments

4.1 Available Plans

BANDGATE offers the following subscription tiers:

• Starter (Free): Limited daily access to core features including 1 mock test per day and basic vocabulary
• BANDGATE Pro ($19/month): Enhanced access including 5 mock tests per day, AI Speaking Coach, and full vocabulary bank
• BANDGATE Premium ($39/month): Unlimited access to all features including unlimited mock tests, pronunciation analysis, and custom study plans

4.2 Billing

Paid subscriptions are billed monthly in advance. Payments are processed securely through Paddle, our authorised payment processor. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

4.3 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' advance notice of any price change. Continued use of the Service after the price change constitutes acceptance of the new price.

5. Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. Please refer to our Refund Policy for full details on eligibility for refunds.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Share your account credentials with others or allow multiple users to access one account
• Attempt to reverse engineer, copy, or replicate any part of the Service
• Use automated tools, bots, or scrapers to access the Service without our written consent
• Upload or transmit any harmful, offensive, or malicious content
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, AI-generated content, software, and design — are the exclusive property of BANDGATE and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial IELTS preparation purposes. This licence does not include the right to reproduce, distribute, or create derivative works from any part of the Service.

IELTS® is a registered trademark of the British Council, IDP: IELTS Australia, and Cambridge Assessment English. BANDGATE is an independent preparation platform and is not affiliated with, endorsed by, or officially connected to these organisations.

8. AI-Generated Content

BANDGATE uses artificial intelligence to generate practice questions, feedback, and study materials. You acknowledge that:

• AI-generated content is for practice purposes only and does not guarantee any specific exam outcome
• AI feedback, band score estimates, and recommendations are approximations and should not replace official IELTS preparation guidance
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content for your specific needs

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

10. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, BANDGATE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will do so, including intellectual property provisions and disclaimers.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

13. Governing Law
